These Terms of Service (“Terms”) govern your access to and use of the 1TapSmartSites website, tools, and services (“Services”). By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Services Overview

1TapSmartSites provides website conversion upgrades, including interactive quizzes, AI-powered chat and booking widgets, click-to-call bars, exit-intent lead capture, and related optimization services. Specific deliverables depend on the plan selected.

2. Account & Eligibility

You must be at least 18 years old and authorized to bind the business you represent. You are responsible for maintaining the accuracy of your account information and for all activity under your account.

3. Fees & Payment

Selected plans require an upfront build fee plus a recurring monthly maintenance fee. Fees are disclosed at checkout and billed through our payment processor. All payments are non-refundable except where covered by our 30-day money-back guarantee, subject to the terms published on our pricing page.

4. Intellectual Property

You retain ownership of your original content, branding, and business information. 1TapSmartSites retains ownership of our proprietary code, templates, frameworks, and methodologies. Upon full payment, you receive a license to use the delivered assets on the domain(s) covered by your active subscription.

5. Acceptable Use

You may not use our Services for unlawful, fraudulent, misleading, or abusive purposes. You may not reverse engineer, resell, or redistribute our proprietary code without written permission.

6. Limitation of Liability

To the fullest extent permitted by law, 1TapSmartSites is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, arising from your use of the Services. Our total liability is limited to the amount you paid for Services in the 12 months preceding the claim.

7. Termination

Either party may terminate the monthly maintenance plan with reasonable notice. Build fees are non-refundable once work has commenced. Upon termination, licensed access to proprietary assets may be suspended unless otherwise agreed in writing.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
